These Terms of Use ("Terms") govern your use of allaroundwebworks.com and any related pages (the "Site"), operated by Sammy Allen, doing business as All Around Web Works ("All Around Web Works," "we," "us," or "our"), Louisville, Kentucky. By using the Site, you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use the Site.

1. Who May Use the Site

You must be at least 18 years old to use the Site's forms or book a call. If you use the Site for a business, you confirm that you are authorized to act for that business.

2. Information on the Site; No Offer

The Site describes our web design services, packages, and example pricing for general information only. Prices, packages, and timelines on the Site are estimates and are not an offer or a contract. Any project is governed only by a written proposal and a signed services agreement. We may change or discontinue any service or price at any time. Nothing on the Site is legal, tax, accessibility-compliance, or other professional advice.

3. Portfolio and Concept Sites

Some portfolio examples are concept sites created for fictional businesses to show our work. They are labeled as concept projects, and any business names, people, reviews, or details on them are fictional. Client examples are shown with permission. Results shown for any project are not a promise of similar results.

4. Our Content and Intellectual Property

The Site and its content, including text, graphics, logos, design, and code, are owned by All Around Web Works or our licensors and are protected by copyright, trademark, and other laws. You may view and print pages for your own personal or internal business use. You may not copy, republish, scrape, or create derivative works from the Site without our written permission. "All Around Web Works" and our logo are our trademarks. Other names and logos belong to their owners.

When you submit a form, booking, or message, you agree that the information is accurate and that you have the right to share it. You grant us permission to use it to respond to you and to provide our services, as described in our Privacy Policy. Please do not send passwords, payment card numbers, or other sensitive information through the Site's forms.

TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT PROMISE THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS, OR THAT ITS INFORMATION IS COMPLETE OR CURRENT.

TO THE FULLEST EXTENT PERMITTED BY LAW, ALL AROUND WEB WORKS AND SAMMY ALLEN WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, OR DATA, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SITE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SITE WILL NOT EXCEED ONE HUNDRED DOLLARS ($100). This section does not apply to a client's claims under a signed services agreement, which has its own terms.

You agree to indemnify and hold harmless All Around Web Works and Sammy Allen from third-party claims, losses, and reasonable attorney fees arising from your misuse of the Site, your violation of these Terms, or content you submit.

13. Governing Law and Venue

These Terms are governed by the laws of the Commonwealth of Kentucky, without regard to conflict-of-laws rules. Any dispute relating to the Site will be brought only in the state courts located in Jefferson County, Kentucky, or the U.S. District Court for the Western District of Kentucky, and you consent to their jurisdiction.

We may update these Terms by posting a new version on this page with a new "Last updated" date. Continued use of the Site after a change means you accept the updated Terms. We may suspend or end access to the Site for anyone who violates these Terms.

15. General

If any part of these Terms is unenforceable, the rest remains in effect. Our failure to enforce a term is not a waiver. These Terms and our Privacy Policy are the entire agreement between you and us about the Site. If our business is transferred to a business entity we form, these Terms will continue to apply between you and that entity.
